Scott focuses his practice on helping individuals and businesses avoid and resolve disputes both in and out of court in the areas of insurance coverage and recovery, construction, employment, real estate and commercial law.
Scott started his career defending insurance companies against claims of bad faith in Colorado state and federal courts. In connection with this experience, Scott regularly analyzed insurance coverage, prepared for and defended corporate representative and claim adjuster depositions, managed standard of care experts, litigated confidentiality and trade secret issues, successfully argued motions, and tried several cases in state and federal court.
At Moye White, Scott leveraged his experience with insurance coverage and bad faith to co-found the firm’s Insurance Coverage and Recovery Group where he focuses on representing commercial policyholders through the nuances of insurance coverage disputes and bad faith litigation. Scott’s experience representing large insurance companies provides him with valuable insight to help his clients obtain insurance coverage, defend his clients in litigation and, if necessary, pursue coverage and bad faith litigation against the insurance company.
Scott also counsels property owners, general contractors and subcontractors with contract review and drafting, in addition to defending and prosecuting construction defect claims arising from single-family and multi-family projects. Scott is a co-author of the Colorado Bar Association Real Estate Forms Deskbook chapter on mechanics’ liens and has experience both pursuing recovery and defending matters involving mechanics’ liens. Scott is also the co-author of the construction law chapter for Colorado Methods of Practice which generally covers most all aspects of construction law in Colorado.
In the area of real estate, Scott represents landlords and tenants in commercial lease disputes and eviction matters throughout Colorado. Because of his trial skills, Scott is regularly sought out to handle contested commercial eviction matters.
Scott has also represented employers in various employment actions including Equal Employment Opportunity Commission charges of discrimination in the areas of disability, age, gender and whistleblower actions, enforcement of non-competition and non-disclosure agreements, and trade secret protection cases.
Additionally, Scott has experience litigating matters involving mineral right acquisitions, business ownership disputes and commercial collection matters.
During his free time, Scott plays ice hockey with his team the Denver Crush and at various charity events for the Associated General Contractors and the National Association for Industrial and Office Parks. Scott also enjoys running, cycling and cheering on the Iowa Hawkeyes.
